Does my Fingerprinting ID # go away when I get a Pardon?

Q.

Does a pardon remove/hide the FPS number (the id # given when you get your fingerprints taken) associated to my name?  I have heard that the US border guards have now been asking whether you’ve ever been fingerprinted.

A.

Yes the FPS number( the id # given when you get your fingerprints taken), which is used to index your federal identification file, is closed when you receive a pardon. It will not be disclosed by CPIC any longer.

Most people who have trouble with FPS numbers are those who were charged but not convicted. When they go to the border, they are asked about their record, to which they reply they do not have a record, only to find out that the U.S. can see the FPS number and want to know why they were fingerprinted.

It will not be an issue for you when you have a pardon; again, assuming you did not enter the U.S. before receiving it.

I don’t live in Canada, can I get a Pardon?

I have a criminal record in Canada from about 6yrs ago, I know I am eligible but I am living overseas right now, how do I start the process?

A.

You can do the Pardon process from anywhere in the world.  The easiest thing to do would be to contact a Pardon Service in Canada and they will be able to do it for you, the only difference will be that you will have to pick up letter of good conduct from the police in the area where you are living.  This is only if you have been living outside of Canada in the last 5 years.

Do I have to Pay my fines before I can receive a Pardon?

Q. Hi, I got a break & enter charge in 2002 and was ordered to pay restitution.  I paid 50% of the fine in 2002 but still have a balance.  My problem is that I want to apply for a Pardon but heard that I will not be accepted unitl I have fully paid these fines.  Is this true?

A. Unfortunately, YES.  You will not be able to remove your criminal record until all fines that were part of your conviction are paid.

Do I need a U.S Entry Waiver?

I have a common assault charge from over 10yrs ago and am planning a trip to Hawaii with my family, I am worried that border protection will not allow me entry because of my criminal record.  Will I be able to go on my trip?

A.

Most criminal charges in Canada make you inadmissible for travel in the U.S (as well as Japan, Australia, Sweden) but there are a few exceptions and thankfully your charge is one of them. The Summary offences that will not prevent you from entering the United States are driving under the influence (DUI) common assault, mischief, and failure to appear in court.  All other charges you will need to obtain a U.S entry waiver to gain entry to the U.S.  The easiest way to obtain a U.S entry waiver is to use a legal service that specializes in Pardons and Waivers.

Fastest Time-Frame to get a Pardon?

Q. I want to start applying for a career in the health care field and I found out they do mandatory criminal record checks, what is the absolute fastest time I can obtain a pardon so I can move forward in my life.?

A. Over the last 1000 or so pardon applications I have done personally the average time has taken about 6 months to fully complete, the quickest time frame I have seen is 4 months but that is very rare and anybody that guarantees they can have it done in under 6 months is flat out lying.  There are ways to speed up the pardon process but you are dealing with too many external organizations to obtain documents to be able to guarantee any length of time.

Do Criminal Records ever go away?

Q. Hey, I have a Criminal Record for drinking and driving from about 25yrs ago, wouldn’t a minor offence like that be automatically deleated off my record by now or do I still need a Pardon?

A. Unfortunately in Canada Criminal Records are on file forever, A Pardon is the only way to clear a criminal record.  The only charges that automatically get removed after a certin number of years are Conditional/Absolute discharges and youth conviction.
